MCA Amnesty Scheme for ROC Penalty Waiver

MCA has periodically notified settlement or amnesty schemes that reduce or waive additional fees for defaulting companies, but no such scheme is permanently in effect — the current position must be checked against the latest MCA notification before quoting a reduced figure to a client.

Why this can't be a fixed answer on a calculator

Unlike the ₹100/day, no-cap rate itself — which has been stable since 1 July 2018 — any scheme that reduces or waives that fee is, by nature, a time-bound notification: it opens on a specific date, closes on a specific date, and applies to specific defaults within specific conditions. A calculator that hardcoded "a scheme is currently active" would be correct only for as long as that specific scheme remained open, and wrong before and after it.

This is why the ROC Penalty Calculator on this site flags "check for an applicable amnesty scheme" as a standing note whenever a multi-year default is computed, rather than asserting either that relief is or isn't currently available — the honest answer changes over time and has to be checked at the point of use.

What to check, and where

Before advising a client on the basis of any amnesty or settlement scheme, confirm directly against the current MCA circular or notification — including the scheme's exact scope (which forms it covers, which financial years, what the reduced fee structure is, and the compliance window to qualify), since historical schemes have varied on all of these points.

If no scheme is currently open, the full accrued ₹100/day figure this calculator computes is the correct number to work from — quoting a discounted figure on the assumption that "there's probably some relief available" without confirming it is a real risk to get wrong in either direction.
